At Art a la Cart, we take data protection seriously, and this Policy and procedures represent one of the most important principles of how our platform operates. This Privacy Statement outlines the basic principles and practices we follow to ensure that your privacy is respected when using our services.
In this Privacy Statement, the term “Art a la Cart services” collectively refers to the Website, Art a la Cart App, and other services provided by Art a la Cart to its members. The terms “Members” or “you” collectively refer to our clients and members of the Art a la Cart services, representatives, and other authorized members of Employers, potential clients, and members of Art a la Cart services (“Members”). This Privacy Statement explains, for example, the types of personal data we process, how we process personal data, and how you can exercise your rights as a data subject (e.g., the right to object, the right of access).
Some of our services may be subject to a separate privacy policy. If a specific privacy policy applies to a particular service, we will publish it in a timely manner in relation to that service.
This Privacy Statement may be updated periodically to reflect changes in data processing practices or otherwise. The current version can be found on the Website. We will not make significant changes to this Privacy Statement or reduce Members’ rights under this Privacy Statement without prior notice to Members.

This Privacy Statement pertains to the processing of personal data of Members and Employers by Art a la Cart. Art a la Cart is part of the AMIK Association, with the official address at Rabina Alkalaja 1, Belgrade, Serbia.

  1. PROCESSING OF PERSONAL DATA AND SOURCES OF DATA

Art a la Cart processes personal data only to the extent necessary and appropriate for the specific purpose of processing. The personal data collected and processed can be divided into two general categories: Member Data and Usage Data.

Member Data

Member and Employer data are personal data collected directly from you in relation to the services you use on the Art a la Cart platform. Member data may be collected in various ways when members register for Art a la Cart services and/or fill out forms. Additionally, note that we also collect details about any transactions and payments you make through Art a la Cart services.

I. Member Data Required for Using Art a la Cart Services

The following personal data collected and processed by us is necessary to ensure the proper execution of the contract between you and us, as well as to comply with our legal obligations.
When registering for Art a la Cart services and creating a member account, you need to provide the following information:

  • Full name;
  • Email address;

In case you withhold or request deletion of the above-mentioned data, or raise an objection, you will not be able to use any of the Art a la Cart services.

II. Member Data Voluntarily Provided During the Use of Art a la Cart Services

Your experience as a member or user may be enhanced by providing the following information, which you voluntarily give us:
Additional account information:

  • Profile picture;
  • Location data (if you consent to the processing of your location data);
  • Other information, aside from mandatory details, which you provide when creating a member account or later when modifying your profile.

III. Other Data. We may also process other information you voluntarily provide to us, such as:

  • Information related to your applications through Art a la Cart services;
  • Information you provide when submitting ratings, comments, or survey responses;
  • Favorite content, employers, and other preferences;
  • Consent or refusal of marketing;
  • Information you provide through phone calls, emails, or chats with our customer support.

Usage Data

Usage data arises from interactions between members and Art a la Cart services. While we generally do not use Usage Data to identify an individual, under certain circumstances, you may be identifiable through this data, independently or when combined or linked with Member Data. In such situations, Usage Data may also be considered personal data that you voluntarily provide, in accordance with applicable laws, and we will treat such data as personal data.
We may automatically collect the following Usage Data when you visit, use, or exchange information within Art a la Cart services:

  • Information describing your device or browser and the Art a la Cart app, their versions, features, capabilities, and settings;
  • Information about your operator, internet provider, and type of network connection, including your IP address;
  • Identifiers provided by your device or third parties for app vendors or advertisers, or identifiers we create;
  • – Country, region, time zone, and geo-IP location level information;
  • – Details of your interaction with Art a la Cart services and how you use them. This includes usage patterns, which features you use, ads, participation in specific campaigns, impressions, and interactions with offers, and order information;
  • Tracking data and transaction reporting initiated by our advertising partners, including timestamps and the identifiers mentioned above.

We use various technologies to collect and store Usage Data, including cookies, webpage storage, and the use of web and app telemetry when members visit the Art a la Cart platform.
Cookies and other website data stored on your device allow us to identify visitors to Art a la Cart services and facilitate their use, creating aggregated information about our visitors. This helps us improve Art a la Cart services and better serve our members. Cookies and other website data will not harm your device or files. We use cookies and other website data to personalize Art a la Cart services and the information we provide based on the individual interests of our members.

Please note that some parts of Art a la Cart services may not function properly if cookies are rejected.
Art a la Cart services use pseudonymized identifiers to track and predict your usa of the app and services, as well as preferences. Art a la Cart also uses third-party tracking technologies which are only used during the session to verify and report transactions initiated by our advertising partners.
You can manage your cookie settings via the cookie banner on our websites.
You can also manage communication and other privacy settings through the Art a la Cart app.
At any time, you can object to automated data processing. After you file an objection, we will no longer be able to process your data automatically unless there are legal and legitimate reasons for doing so.
Visitor identifiers for Art a la Cart can be disabled on iOS and Android mobile devices by adjusting the settings (for iOS: Settings → Art a la Cart → Art a la Cart Settings → Limit Tracking, and for Android: Art a la Cart app → Profile Tab → Settings icon in the upper right corner).

  1. PURPOSE AND BASIS FOR PROCESSING

We process personal data only to the extent necessary and appropriate for specific processing purposes. Note that one or more of the following purposes and legal bases may apply simultaneously. Firstly, Art a la Cart processes your personal data to fulfill its contractual obligations to you to the extent necessary for:

  • Providing Art a la Cart services to you within the contract between you and Art a la Cart;
  • Executing the contract between you and Art a la Cart and for managing your check-in, as well as communicating with you about changes to terms of use, privacy policies, or other important changes related to the contract;
  • Processing your payments or any refunds (where applicable);
  • Responding to your inquiries or resolving technical support cases if you contact us.

Additionally, we may process your personal data if there is a legitimate and justified interest in managing, maintaining, and developing our business or creating and maintaining relationships with Employers. When we decide to use your data in addition to your consent, we balance our interests against your right to privacy and provide you with the opportunity to easily unsubscribe from our marketing communications, using pseudonymized or non-personally identifiable data whenever possible. You have the right to object to the processing of your data based on legitimate interest. However, Art a la Cart may reject such an objection in accordance with applicable legislation, for example, if the processing is necessary for the preparation, establishment, or defense of legal claims.
We process your personal data to the extent necessary to fulfill obligations, improving services, complying with legal requirements, and in other cases based on your consent, for example:

  • Resolving requests, debt collection, and legal processes. We may also process data for fraud prevention, misuse of our services, and for information, system, and network security.
  • Contacting you regarding Art a la Cart services and informing you about changes related to them, or asking for your review or feedback on Art a la Cart services.
  • Requesting Art a la Cart services or displaying targeted or personalized ads through Art a la Cart services or sending targeted marketing services or products that may interest you. To form such a target group, we may process information mentioned above in the “Usage Data” section. Note that personal data processing for marketing purposes will be based on your consent (also see the “Direct Marketing” section below).
  • Improving the quality of Art a la Cart services and developing our business by analyzing usage trends via the processing of data related to your use of Art a la Cart services.
  • Ensuring that our services meet your needs, personal data may be used for things like user satisfaction surveys. Whenever possible, this will be done using aggregated non-personally identifiable data.

During the processing of your personal data for the provision of Art a la Cart services to you, as well as for other stated purposes, we may use automated processing methods, which may include automated decision-making.

Additionally, we may process your personal data in order to administer and fulfill our legal obligations. This includes data processed for fulfilling accounting obligations and providing information to competent authorities, such as tax authorities or law enforcement agencies, in accordance with legal requirements.

In some parts of Art a la Cart services, you may be asked to provide your consent for the processing of personal data. For example, within the Art a la Cart app, you can manage your marketing and other permissions. If the processing of your personal data is based on your consent, you can withdraw it at any time by contacting us or by changing the relevant consent settings, for example, within the Art a la Cart app.

  1. RECIPIENTS OF DATA

We only share your personal data within the Art a la Cart organization.

We do not share your personal data with third parties outside of the Art a la Cart organization unless there is a legal obligation imposed by government authorities.

If Art a la Cart participates in a merger, acquisition, or asset sale, we may transfer your personal data to a third party involved in the transaction. However, we will continue to ensure the confidentiality of all personal data and and we will request your renewed consent for the processing of your personal data.

  1. DATA RETENTION PERIOD

Art a la Cart does not retain your personal data longer than legally allowed and necessary for the purposes of providing Art a la Cart services or the relevant parts of those services. The retention period depends on the nature of the information and the purpose of the processing. The maximum period may therefore vary depending on the type of data.

After a member deletes their account, personal data may only be stored as long as such processing is legally required or reasonably necessary for our legal obligations or legitimate interests, such as resolving claims, accounting, internal reporting, and obligations settlement.

We regularly assess the data retention period to ensure that data is kept only for the necessary period.

  1. YOUR RIGHTS

Right to Access

You have the right to request, access, and be informed about the personal data we process about you. We provide you with the ability to review certain data through your membership account within Art a la Cart services or to request a copy of your personal data.

Right to Withdraw Consent

If the processing is based on consent provided by the member, the member may withdraw consent at any time freeof charge. Withdrawing consent may result in reduced access to Art a la Cart services. Withdrawal of consent does not affect the lawfulness of processing based on consent before it was withdrawn.

Right to Rectification

You have the right to request the correction or completion of inaccurate or incomplete personal data we have stored about you. Some of your personal data can be corrected or updated through your membership account within Art a la Cart services.

Right to Erasure

You can also request that we delete your personal data from our systems. We will comply with such a request unless we have a legitimate reason not to delete the data.

Right to Object

You have the right to object to the use of your personal data if such data is processed for purposes other than those necessary for the execution of Art a la Cart services or for the fulfillment of legal obligations. If you object to further processing of your personal data, it may limit your ability to use Art a la Cart services.

Right to Lodge a Complaint

If a User believes that the processing of personal data is in violation of applicable data protection laws, the member may file a complaint with the local data protection supervisory authority in Serbia, the Commissioner for Information of Public Importance and Personal Data Protection. Additionally, the member may file a complaint with another relevant local supervisory authority for data protection.

Right to Restrict Processing

You can object to the processing of your personal data and request us to limit the processing of your personal data, for example, when your requests for deletion, correction, or objection are ongoing and/or when we have no legitimate grounds for processing your data. After the objection is made, AMIK will no longer be able to process the data unless there are legal and justified reasons. However, this may lead to suspension or limited possibilities of using Art a la Cart services.

Right to Data Portability

You have the right to receive the personal data you have provided to us in a structured and commonly used format and transfer it independently to a third party.

How to Exercise Your Rights

You can exercise the aforementioned rights by contacting Art a la Cart support or by sending a letter or email to the address provided above, including the following information: full name, address, and email address. If you have an Art a la Cart account, we recommend contacting us via Art a la Cart support to help us identify you more easily. We may refuse or charge for requests that are unreasonable, excessive, or clearly unfounded.

  1. DIRECT MARKETING

AMIK may use all collected personal data, given with the consent of the User, for the purpose of creating personalized offers related to the services it provides, notifying about the expiration date and the possibility of renewing the account, as well as contacting the User regarding other projects and services offered by Art a la Cart that may be of interest to the User based on the processed data. The Member can at any time revoke the processing for these purposes by contacting the customer support center.

  1. INFORMATION SECURITY

AMIK stores all data in databases and servers protected by modern security technologies, continuously implementing measures to ensure the security of the data being processed. We use administrative, organizational, technical, and physical measures to protect the personal data we collect and process. These measures include, for example, encryption, pseudonymization, firewalls, secure facilities, and access control systems, where appropriate. Our security control mechanisms are designed to maintain an appropriate level of confidentiality, integrity, availability, resilience, and data recovery capability. We regularly test Art a la Cart services, systems, and other resources for security vulnerabilities. Additionally, access to personal data by Art a la Cart employees is restricted and limited to what is necessary for the tasks assigned to the employee.

  1. CHANGES TO THE PRIVACY STATEMENT

We will periodically update this Privacy Statement due to changes in our practices and services. When we make changes, we will modify the “last updated” date at the top of the privacy statement. If we make significant changes to how we collect, use, and share personal data, we will notify you through a notice on the website. By continuing to use the Interactive Service after changes to the Privacy Policy, it is implied that the User accepts all terms of the modified Privacy Policy.
